This Agreement is made by and between Action Farms and the above referenced “Owner”, and is subject to the following terms and conditions.

1. If Stud Fee is paid upon arrival of mare at Action Farms, a Breeding Certificate will be given to the owner when the mare is picked up; if Stud Fee is paid when the mare is picked up, the Breeding Certificate will be mailed to owner when the check has cleared.
2. Action Farms agrees to provide board, feed, and general care/stallion service for owner’s mare while in their care; owner shall be charged at the current board rate.  (2005 rates: $8.00 per day for a dry mare in stall and $9.00 per day for a mare and foal in stall.) 
3. Any board, farrier, veterinary, and/or other expenses incurred by Action Farms on behalf of or for the benefit of owner’s mare will be billed to owner monthly.  Furthermore, owner agrees to have reproductive procedures conducted as deemed necessary by the attending veterinarian.
4. Owner gives consent to Action Farms to provide/procure emergency veterinary care.  No elective procedures will be conducted without owner’s consent.  Owner further agrees to hold Action Farms harmless from any claim resulting from damages or injury caused by or to owner’s mare and/or foal.  Owner assumes all risk of loss or damage to the horse(s) and should insure against same.
5. Owner must present a current health certificate, Coggins certificate and proof of clean culture, and states, by signature below, that the mare is in good physical condition, free of disease and infection.
6. Breeding to the above-named stallion is with “Live Foal Guarantee”.  In the event the mare does not settle, she may be brought back to Action Farms for additional breeding during the current breeding year.  In the event that the mare does not carry to term, or that the foal dies at birth, the stud fee will be applied to the next breeding year.  However, board, veterinary and incidental expenses, if any, will be billed to the owner for each farm visit.
